Terms of Service

These Terms of Service (the "Terms") govern your use of the GiantBooking platform, operated by GiantBooking ("GiantBooking", "we", "us"). By creating an account or using the service, you agree to these Terms on behalf of yourself and the business you represent ("Customer", "you").
1. What the service does
GiantBooking provides an AI receptionist that answers inbound phone calls, SMS messages, and web-chat sessions. The agent can hold a conversation, check live calendar availability, book and cancel appointments, and send confirmations. Every action the agent takes is authorized by an internal policy gate and recorded in a signed audit trail.
2. AI usage disclosure
Callers, texters, and chat visitors interact with artificial intelligence. You are responsible for disclosing this to the people who contact your business in the manner required by the laws that apply to you, including state-level two-party disclosure rules for recorded or AI-mediated calls. GiantBooking surfaces the name of your business at the start of every conversation but does not by itself replace your disclosure obligations.
The AI may make mistakes. It can mishear, misinterpret intent, or misstate policy. You should review booking outcomes and transcripts periodically and configure escalation rules so that callers can reach a human when they need one.
3. Your account
You must provide accurate sign-up information, keep your credentials secure, and promptly notify us of any suspected unauthorized use. You are responsible for all activity that occurs under your account.
4. Fees and billing
Subscription fees are billed in advance through our payment processor (Stripe). Plans renew automatically until cancelled. Fees are non-refundable except where required by law. We may change prices with at least 30 days notice for existing plans.
5. Data handling
Your use of the service is also governed by our Privacy Policy, which describes what we collect, how we store it, and who it is shared with. Sensitive fields (phone numbers, transcripts, system prompts) are encrypted at rest with AES-256-GCM and in transit with TLS.
6. Service availability
We target a monthly uptime of at least 99.5% measured across the voice, SMS, and web-chat channels. Planned maintenance is announced in advance. We do not offer an SLA credit guarantee on Starter or Pro plans; custom SLAs are available on the Scale plan by written agreement.
7. Acceptable use
You must comply with our Acceptable Use Policy. We may suspend or terminate accounts that violate it, including accounts used for unsolicited calling, harassment, fraud, or any unlawful activity.
8. Intellectual property
We retain ownership of the GiantBooking platform, software, and brand. You retain ownership of your content, including your system prompts, call transcripts, and customer records. You grant us a limited license to process that content solely to deliver the service.
9. Termination
You may cancel at any time from the dashboard. We may terminate or suspend your account for violation of these Terms, non-payment, or risk to the platform or other users. After termination you may request export or deletion of your data as described in the Privacy Policy.
10. Disclaimer of warranties
The service is provided "as is" and "as available". We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the AI agent will be error-free or that the service will be uninterrupted.
11. Limitation of liability
To the maximum extent permitted by law, GiantBooking's total liability to you for any claim arising out of or relating to the service is limited to the fees you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Disputes must be brought in the state or federal courts located in Delaware.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or in the dashboard at least 30 days before they take effect. Continuing to use the service after an update means you accept the revised Terms.
